Employment Law - A Survival Guide for Employers
Employment law in the UK has seen many important changes in recent months that have had a significant impact on the rights of employees and the responsibilities of employers.  Changes in the law regarding age discrimination, maternity and paternity rights, flexible working, holiday entitlement and smoking at work have all increased the pressure on employers to understand their legal obligations and implement the necessary practices and procedures. Further major changes are forthcoming between now and 2010. It is absolutely vital that anyone with the responsibility for managing people in the workplace understands the importance of these changes and the consequences of failing to comply with UK employment law. This one day seminar will bring you right up to date with all the essential aspects of current legislation and fully equip you to comply with the law and avoid the costly consequences of an employment tribunal.

The course answers the following questions
  • What are the responsibilities of the employer?  What statutory rights does the employee have?

  • How do the rules concerning the Asylum and Immigration Act affect employers?

  • What checks should be carried out on criminal records, references and medical reports?

  • Which terms are implied in a contract of employment?  Which statutory terms are imposed?

  • What are an employer’s responsibilities in relation to sick pay, equal pay, maternity leave and the Working Time Regulations?

  • What is the National Minimum Wage?  Who is exempt?

  • What are the implications of the Work and Families Act 2006 for employers of working parents and carers?

  • What are the regulations for part-time employees and people on fixed term contracts?

  • What are the implications of the Employment Equality (Age)Regulations 2006?

  • What impact do the Sexual Orientation and Religion or Belief Regulations have on employers?

  • What steps should an employer take to comply with the Disability Discrimination Act?

  • What notice period is an employee entitled to?

  • What are the effects of the statutory disciplinary and grievance procedures?

  • How should an employer properly terminate an employment contract?

  • What constitutes wrongful dismissal?  What is constructive dismissal?

  • What is the effect of paying an employee in lieu of notice? What is gardening leave?

  • What constitutes gross misconduct?  How will the new statutory disciplinary and grievance procedures affect the termination of employment contracts?

  • Can an employer terminate an employment contract when an employee is absent due to long-term sickness?

  • What is the role of an Employment Tribunal?

  • What is a compromise agreement and a COT3 settlement?  How are the basic and compensatory awards calculated?

  • What constitutes redundancy?  How do you calculate an employee’s basic entitlement to redundancy pay?
