The new Bribery Act 2010 should be in force by Commencement Order by 1 April 2011. An important provision in the Act is the creation of the offence of an organisation ‘failing negligently to prevent bribery within it’. Upon conviction upon indictment a corporate body or a partnership could have an unlimited fine imposed on the corporate body or on the assets of a partnership. Also its directors, partners and/or senior managers could be subject to prosecution and, if found guilty, could face a term of imprisonment for up to ten years. Bribery outside the UK is within the Act including the Bribery of Foreign Officials. Bribery involving agents, subsidiaries, and intermediaries could make your organisation guilty of failing negligently to prevent bribery. This seminar will provide you with the essential information, including an explanation of the
statutory defences available, so as to avoid the possibility of a prosecution. The Act will be related to associated legislation, e.g. Fraud Act 2006 and where appropriate, contract law.
