To provide delegates with an understanding of the law concerning access to communications data by public authorities. Delegates will be given an insight into the communications data available and practical guidance relating to the process of obtaining, analysing and retaining it.

Learning Outcomes
At the conclusion of the course delegates will be able to: -

  • Develop an understanding of best practice procedures as detailed in the ACPO Manual of Standards for Accessing Communications Data.
  • Understand the requirements of Part I, Chapter II, Regulation of Investigatory Powers Act 2000 - Accessing Communications Data.
  • Comply with best practice in relation to submitting application forms for accessing communications data.
  • Understand the impact of Human Rights legislation and the tests of necessity, proportionality and collateral intrusion in relation to applications under RIPA.
  • Be aware of the types of data retained by Communications and Internet Service Providers that could assist major incidents or investigations, and how to interpret the data provided by different providers.
  • Understand the different legislative requirements for accessing data held on communications devices, e.g. mobile telephone handsets, SIM cards, PDA's etc.
  • Understand the procedures surrounding using communications data as evidence.
  • Apply analytical methods to make best use of communications data to assist with achieving investigation objectives.
