Through the Premium Pack and paid services, Emagister is committed to offering the Customer.

1. Full satisfaction guarantee

The Customer may request to discontinue the service for any reason, switching to the Free Pack. The service will be terminated on the first day of the month following the request.
Requirements in order to make effective the request to discontinue the service:

  1. The contract must be in force and the Customer must be up to date in the payment.
  2. The Customer must give effective notification to Emagister.
  3. Once the Customer has given notification, Emagister shall respond within a period of two business days, indicating the steps to take and, where applicable, shall proceed to suspend the service(s) contracted.
  4. The procedure shall include:
    1. Closure of billing, which consists of counting and reviewing the services open.
    2. Issue of an invoice for the services opened by Emagister to the Customer.
    3. Once the invoice has been received by the Customer, the invoice must be paid by the Customer within 10 (ten) business days.
    4. The Customer shall effectively notify payment of the invoice.
    5. Once the notification has been received, Emagister shall send the Customer confirmation of the final cancellation of the service within a period of no more than 15 (fifteen) business days.

2. Guarantee of Return on Investment

Emagister guarantees the Customer an annual invoicing equivalent to double the investment made on Emagister leads.
In the event that said invoice amount is not reached, the Customer shall have the right to request a refund of its payments until reaching said invoice amount with a maximum of the amount invested.
Requirements for the refund:

  1. The Customer must remain in the Service for a minimum of twelve (12) consecutive months as of the start of the present contract. Each year the guarantee shall be renewed for successive periods of (12) months.
  2. The contract must be in force and the Customer must be up to date in the payment.
  3. In the case where the Customer considers that this guarantee has not been fulfilled, it must effectively communicate this to Emagister.
  4. The period for effective notification shall expire 30 calendar days after one calendar year has passed since acceptance of the service, and shall become open again the following calendar year. If the Customer does not give effective notification within said time period, the guarantee shall be considered fulfilled for that period, forfeiting any right to claim compensation.
  5. Once Emagister has received the effective notification, within a period of no more than 15 business days, it shall inform the Customer of the Auditor appointed for studying the case, the Auditor's fees and the period in which the Auditor shall begin to analyze the Customer's financial statements. In this regard, the Customer waives choosing an Auditor, it being the responsibility of Emagister to choose one.
  6. The Auditor shall notify the Customer and Emagister of the resolution of the claim within a period of no more than 30 calendar days as of the completion of the audit.
  7. The Customer and Emagister expressly agree to provide the Auditor with all the documentation required by the Auditor in order to perform the audit.
  8. The Auditor shall issue an opinion in which the Auditor shall indicate the result of his/her work and, where applicable, the differences established between the service and the income generated by the Customer.
  9. Where appropriate, the amount to be paid by Emagister shall be calculated by means of the difference between the invoices issued by Emagister to the Customer for the leads generated in such period of time, multiplied by two, and the total amount invoiced by the Customer as a result of the leads received by Emagister in the aforementioned period of time, and up to a maximum of the amount invoiced by Emagister.
  10. In the event that the resolution of the claim is in the Customer's favor, Emagister shall pay the cost of the Auditor as well as provide the Customer a volume of leads equivalent to said amount to be compensated.
  11. In the case where the resolution of the claim is not in the Customer's favor, the Customer expressly agrees to pay the Auditor's fees.

3. Guarantee of limitation of receipt of interested users

Emagister guarantees the Customer that it may deactivate the receipt of leads toward its course offering at any time.
This guarantee applies according to the following series of clauses:

  1. That this deactivation shall be effective at the moment when the Customer makes it effective through its Education Center Menu. After that time, Emagister shall not collect payment for any lead that it may have sent the Customer in error.
  2. Emagister accepts that this deactivation shall be valid until the end of the month and shall be reversed in an unattended manner and automatically by Emagister on the first calendar day of the month after which the Customer deactivated the receipt of leads.
  3. That during this period of deactivation, in an effort to provide good service to its users, Emagister may recommend and redirect the interested users toward course offerings similar to the Customer's competition.

4. Guarantee of Visits

Emagister undertakes to ensure that the Customer receives the number of visits established in the contract.
This guarantee applies according to the following series of clauses:

  1. This guarantee is only applicable for services operated in Spain.
  2. The contract must be in force and the Customer must be up to date in the payment.
  3. In the case where Emagister does not reach the number of visits contracted within the period of time described in the section of services contracted as stated in the contract, it shall automatically continue serving visits until reaching the amount contracted, without this policy resulting in an increase in the price for the Customer.
  4. The Customer is responsible for maintaining the URL that it indicates for providing the service, exempting Emagister from any liability with regard to the URL of the Customer and its proper functioning.

5. Guarantee of people interested

Emagister guarantees the Customer that, either through the section of requests for information, or through the section E+, during the current month it will have been able to access the data of at least 5 users interested in courses that might fit with its course offering.
This guarantee is applied in accordance with the following requirements:

  1. The contract must be in force and the Customer must be up to date in the payment.
  2. The Customer must remain in the Service for a minimum of three (3) consecutive months.
  3. This guarantee shall only be applicable in the case where the Customer has published a minimum of 5 courses that follow the Emagister standards for publication.
  4. This guarantee will not be applicable if the Customer has activated the limitation of receipt of interested persons.
  5. In the case where, during the current month, the Customer does not have any requests by users interested in one of the channels indicated in the points above, the Customer must effectively inform Emagister between the 1st and 5th day of the following month that it has not received any requests from interested users. In the case where there is no communication, the Customer thus acknowledges that it has indeed received requests from interested users in at least one of the courses of the educational programs published.
  6. In a period of no more than 5 (five) business days, Emagister shall verify that the Customer has not received requests from interested users and, where applicable, shall thus work to bring about a positive resolution.
  7. In the case where the resolution is positive, Emagister shall proceed to issue the Customer a credit note within the following 15 (fifteen) business days and shall not collect the following monthly fee from the Customer.
