The term of lease, in law, refers to a contract, with which a party (called lessor) undertakes to allow another person (tenant or tenant) to use a thing for a given time in exchange of a specific fee (the so-called "rent" or "rent"). The lease contract derives from the Roman institute of the locatio conductio, which included a broader case in point than the current counterpart. The civil code defines the lease (Article 1571 of the Civil Code) as the contract by which one party, called lessor, undertakes to make the other party, i.e. the tenant or tenant or tenant enjoy a movable or immovable thing for a given time. towards a specific fee, i.e. the rental fee. The lease contract can be classified differently according to its object (movable or immovable property) or the destination of the assets (real estate for residential or commercial use), the type of real estate, urban or not (think rural properties) or the period of time (transitional contracts) or the type of fee (free or agreed fee). The lessor is the one who grants the leased asset; usually, he coincides with the owner of the thing, but he can also be the owner of the right that allows the transfer of the enjoyment and possession of the asset, think of the usufructuary. The tenant or tenant or tenant is the contractual counterparty to whom the leased property is granted. With the contract, he becomes the holder of a personal right of enjoyment, which is a personal and relative right, not enforceable against third parties; in essence, it is the right of a person (the tenant) towards another person (the lessor) and cannot be asserted against third parties unrelated to the relationship, except in the cases established by law.
