"The magistrate is a public official vested with judicial powers, to whom the functions of Judge and Public Prosecutor are entrusted. The Magistrate's task is to enforce and apply the current law of the State, through the conduct of a process in all its phases. The activities that the MAGISTRATE carries out are of two types: ""judging"" - when the Magistrate is Judge and therefore decides on disputes or pronounces on matters within his competence, ""prosecutors"" - when the Magistrate is Public Prosecutor and therefore expresses requests, conducts investigations in view of the decisions of the judicial bodies. The Magistrates are divided into: PM or Public Prosecutor, responsible for carrying out the criminal action, GIP or Judge for Preliminary Investigations, with functions that must guarantee the suspect in the preliminary investigations, GUP or Preliminary Hearing Judge, who decides on the indictment of the accused or on the application of the sentence, criminal judge who decides on the accusation, civil judge who decides on disputes between private individuals. The profession is regulated by the Law on the judiciary. Access to the profession of ordinary magistrate (therefore we do not speak of the administrative judge, nor of the justice of the peace) passes through the passing of a public competition for exams. In addition to the law degree, the requirements that candidates must possess are differentiated (internship at the judicial offices, 18-month internship at the State Attorney's Office, diploma from a specialization school for the legal professions, doctorate in subjects law, university teaching of law subjects,
