RSPP course The head of the prevention and protection service (RSPP - defined by art.32 of Legislative Decree 81/2008) is the person, in possession of the professional skills and requirements, designated by the employer, to coordinate the service of prevention and protection from risks, i.e. the set of people, systems and means external or internal to the company aimed at preventing and protecting workers from professional risks. He is a mandatory figure and is a safety adviser to the employer. The RSPP is the person who evaluates the risk factors present within a work activity and who designs and plans the improvement program to ensure the safety of workers, while the EMPLOYER is the only figure who holds the spending power within the working context to implement all the provisions drawn up by the RSPP. The head of the prevention and protection service collaborates with the employer, the competent doctor and the workers' safety representative to create the risk assessment document. The head of the prevention and protection service participates together with the competent doctor and the workers' safety representative in the periodic meeting held annually by the employer. The appointment of the RSPP is one of the non-delegable obligations of the employer (Article 17 of Legislative Decree 81/08). The RSPP can be internal or it can be a professional external to the company. The law does not provide for contraventions for the person in charge of the prevention and protection service; however he is responsible for the offense of the event if the injury occurs due to the incorrectly given advice. The RSPP, in fact, responds together with the employer whenever the occurrence of an accident is objectively attributable to a dangerous situation that he would have been obliged to know and report.
