The prohibitions and penalties of the Transfer of Undertaking (Protection) of Employment Regulations 2006 and the Collective Redundancies and Transfer of Undertakings (Protection of Employment) (Amendment) Regulations 2014 amass numerous complexities in protection to the rights of the employee in matters of business sale or merger transfer. It is insufficient to note a business or merger transfer from A to B without added conundrums and puzzled employee rights, insolvency, pension rights, unionism, collective rights and representations, warranties, covenants, terms and conditions not forgetting breaches and issues of restitution thrown into the TUPE melting pot etc. The conundrums goes still further often meted out by the courts through judicial interpretations centred around dismissal, what constitutes undertakings, groupings and activities, to an (ETO) economic, technical or organisational to reasoning entailing ‘changes in the workforce’ etc. This makes TUPE knowledge a must have in any HR Department in the age of organisational mergers and acquisition.

At the end of the programme: learners will be able to demonstrate a good understanding and knowledge on how TUPE applies/ don't apply in matters of a relevant transfer of undertakings context; whether in a business, SPC, employee context; to pension and redundancies rights; learners will also understand terms and conditional changes to issues of union rights and collective agreements including, information, consultation and representations etc; learners will also understand the areas of a dismissals and consequences for such dismissals including the rights of employees rights in matters of transfer as in refusal etc; learners will also have an understanding of breaches and failure to observe rules contained within the TUPE regulations

Course programme
The transfer of undertaking is a highly complex piece of EU Law made all the more difficult translated into UK Domestic Law. The programme examine in depth the workings of TUPE as applied in the areas of every day mergers and acquisitions. Such mergers and acquisitions encounter numerous problems made al the more difficult with the inception of TUPE. We not only examine the 2006 regulations but also the related amendments added in 2014. The programme is delivered over 1 day. It is important that the delegates attend with a view to fully participating in this highly interactive programme. CBC has employed and consolidates a number of learning and training methods and approaches in programme delivery much of which is exercised based. As the programme contains numerous references to UK and EU Legislation, case law will form the backbone of course delivery as case law best illustrates the operations of the regulations. As well as having a spacious environment for programme delivery, group interaction is encouraged throughout.
Further, although social media and technology is made use of throughout the programme, this is minimised as understandings of legal concepts are best suited to group work interaction.
