The Deprivation of Liberty Safeguards have been the cause of much anxiety and confusion since they came into being in April 2009. Through his work as both a best interests assessor and the Chief Executive of a residential care provider, Chris Wall has gathered vast knowledge and experience of the Safeguards from different angles and has developed a tool to make the identification of Deprivation of Liberty simpler.
This course is designed to do just that and is built around a straightforward matrix. Whether you use the matrix or not is irrelevant, it is the methodology that counts. The matrix shows the key aspects to identifying Deprivation of Liberty and a distinct process for doing it. The process takes practitioners to the point of identifying DOL and deciding whether and when to seek authorisation.
-Be aware of the amendments to the Mental Capacity Act 2005 contained in the Mental Health Act 2007
-Be able to identify where a deprivation of liberty is taking place and the
threshold for authorisation
-Be able to identify whether a deprivation of liberty is the only way in which the person's needs can be met
-Be able to challenge whether a deprivation of liberty is the least restrictive
alternative that is in the person's best interests
-Be able to identify reasonable alternatives that are less restrictive and able to meet the person's needs
