The owner is the one who manages the ship, regardless of whether or not he is the owner. Operation of the ship means that set of functions, activities and responsibilities that are assumed by those who manage it. The requirements for becoming shipowner are: availability of the ship and being the holder of employment relationships with the crew. The following can assume the quality of shipowner: natural persons, legal persons, shipping companies between co-owners and associations. In order to make known to third parties who has the operation of the ship, the law requires that the shipowner, before taking on the operation of the ship, makes the "owner's declaration" with the maritime authority where the ship is registered. If the shipowner does not make the declaration, the law assumes that the shipowner is the owner and therefore it is up to the owner to verify that the shipowner has made the declaration, being able, failing that, to make it in his place and on his behalf. Article 275 of the Italian navigation code provides that the shipowner can limit the overall debt arising from the obligations arising during a voyage to a limit sum equal to the value of the ship plus the value of the freight, plus the other proceeds of the voyage. . The owner can apply for the benefit of the limitation before the start of the voyage, during the voyage but not beyond the end of the voyage. If requested prior to the commencement of the voyage, the value of the ship is determined at the time the restriction is requested; if asked during the trip, the value to be calculated on the ship must be between 1/5 and 2/5 of the value the ship had at the beginning of the voyage. The value of the ship is identified on the basis of the value attributed to the ship in the insurance policies, or on the basis of the value corresponding to the ship's class certificate.
