Content review:

Colin will look afresh at developments since section 55, ZH (Tanzania) and Zambrano, including a review of relevant case law from the European Court of Justice, Court of Appeal, High Court and Upper Tribunal. Topics will include the vexed issues of whether a failure to address section 55 properly or at all should lead to remittal or whether the tribunal should get on with the assessment itself and the implications of the proactive duty on UKBA and, arguably, the tribunal and courts.
